These Terms of Service (the âTermsâ) govern your access to and use of SKAP. By creating an account, purchasing credits, uploading files, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
SKAP is a cloud based Software as a Service platform that processes customer provided files through our API and computing pipeline in order to generate texture related results including maps (the âResulted Mapsâ).
The Service operates entirely on Amazon Web Services, Supabase and Stripe, files and results are stored on Amazon S3 for limited retention periods described below.
We may update or modify the Service at any time. We do not guarantee that any feature will remain available forever.
2. Eligibility and Account Registration
You must be at least 18 years old (or the age of majority in your jurisdiction) to use SKAP.
When registering, you must provide accurate and complete information. You are responsible for all activity on your account, including any use by your employees, contractors, or collaborators.
Login uses one time password authentication by email. You are responsible for maintaining access to your email and securing your login credentials.
3. Personal Data and Privacy
We store user account data through Supabase, including:
- name and surname
- email address
- credits balance
- job history and processing metadata
- payment history
We do not store credit card details. Payments are processed by Stripe via embedded Stripe Checkout. Stripe may collect and store payment information directly in accordance with their own terms and privacy policy.
Our full Privacy Policy is incorporated into these Terms by reference. If there is any conflict between these Terms and the Privacy Policy, the Privacy Policy governs personal data handling.
4. File Uploads, Processing, and Storage
4.1 Customer Files
You may upload files to SKAP solely for processing through the Service. You confirm that you own all rights necessary to upload and process these files, or that you have proper authorization from the rights holder.
4.2 Storage Retention
- Uploaded customer files are stored on S3 for 7 days after upload.
- Resulted Maps are stored on S3 for 30 days after generation.
After these periods, files and results may be automatically deleted and cannot be recovered. You are solely responsible for downloading and backing up your results before deletion.
4.3 No Sharing Without Permission
We will not disclose, share, sell, or distribute customer files or Resulted Maps to any third party unless:
- required by law, or
- we have your explicit written approval
5. Customer Responsibilities and Data Compliance
You are fully responsible for:
- the content, legality, quality, and appropriateness of all files you submit
- ensuring that your input data meets SKAP technical requirements
- reading and following our processing guidelines and helpers on the job submission page
SKAP does not verify that your data is correct, complete, or fit for processing. If your files are incorrect, incomplete, low quality, corrupted, or not compliant with our requirements, results may be degraded, inaccurate, or impossible to generate. We are not liable for such outcomes.
Additional Debugging and Validation Rights :
To ensure proper operation of the services and to prevent processing failures, SKAP may, on an exceptional and limited basis, access, inspect, or review submitted input files solely for technical debugging, validation, and diagnostic purposes. This may occur when automated checks or system behavior indicate potentially invalid, incompatible, or abnormal input parameters that could lead to a failed or degraded job.
Such access is strictly limited to what is reasonably necessary to:
verify technical compliance with SKAP requirements,
identify the cause of processing issues or imminent failures,
and inform the customer of detected problems or recommended corrections.
SKAP does not routinely review customer files and does not assume responsibility for validating the business or functional correctness of the data. Any inspection performed under this provision does not transfer responsibility for the input data or resulting outcomes to SKAP.
You must not upload any files that:
- infringe third party intellectual property rights
- violate confidentiality or contractual restrictions
- are unlawful, harmful, or contain malicious code
- include personal data that you do not have the right to process
6. Credits, Pricing, and Payments
6.1 Credits System
SKAP operates on a prepaid credit basis.
- 1 USD = 1 credit
- Credits are consumed when jobs start processing.
Pricing, consumption rules, and job costs may be updated from time to time and are displayed in the Service.
6.2 No Refund Policy
Because credits provide immediate access to compute resources and job processing, credits are non refundable once purchased.
6.3 Exceptions and Job Failures
In rare cases of confirmed Service failure, we may at our discretion:
- reprocess the job at no additional credit cost, or
- return credits equivalent to the failed jobâs cost
Any compensation is strictly limited to credits. We are not obligated to provide cash refunds. Decisions are made case by case.
7. Licenses for Resulted Maps
When registering, you must select one of two licenses. Your selection determines how you may use the Resulted Maps.
7.1 Personal Use License
Under the Personal Use License:
You may use Resulted Maps in personal projects or non commercial projects.
Commercial use is prohibited, except for freelancers as defined below.
Freelancer exception:
A âFreelancerâ is an independent individual who:
- is not an employee of the client or company they work for
- operates as their own business entity
- pays their own taxes and professional expenses
- is contracted per project or per service
Freelancers may use Resulted Maps commercially under a Personal Use License for their own client work, but the Resulted Maps may not be transferred to or reused by the client company beyond the freelancerâs licensed production.
7.2 Commercial Use License
Under the Commercial Use License:
A company or studio may use the Resulted Maps:
- commercially
- across multiple Licensed Productions if needed
- and may share the Resulted Maps with third parties only when those third parties are working on the same Licensed Production (for example, the same film, game, or series)
This includes the right to share materials with subcontractors, vendors, or partner studios contributing to the same asset in the same production.
7.3 No AI Training or Generative Use
Regardless of license type, you are strictly prohibited from using Resulted Maps or any SKAP output for:
- training AI systems
- generative AI datasets
- machine learning or deep learning model training
- any automated dataset harvesting or synthesis
This restriction applies to internal use, third party use, open source datasets, or any other form of AI or model development.
8. Intellectual Property
8.1 Your Content
You retain full ownership of the files you upload and the Resulted Maps generated from them, subject to the license terms above.
8.2 Our Technology
SKAP, including the API, processing pipeline, code, infrastructure design, UI, branding, and all related technology are owned by TexturingXYZ SARL and protected by intellectual property laws.
You may not:
- reverse engineer, copy, modify, or extract our technology
- access our systems outside normal Service use
- attempt to bypass credit or authentication systems
- use SKAP to build a competing service
9. Security and Restricted Environments
SKAP is a cloud based service. If your organization prohibits cloud computing or external storage for security reasons, you must not upload protected or restricted data to the Service.
We offer an alternative processing option in accredited facilities compliant with major studio security standards (including Disney, Paramount, HBO, Warner Bros, Netflix, and others). Contact us at [email protected] to discuss secure or on premises workflows.
10. Disclaimer of Warranties
SKAP is provided âas isâ and âas availableâ.
To the maximum extent permitted by law, we disclaim all warranties, including:
- that the Service will be uninterrupted, error free, or secure
- that results will be accurate, complete, or fit for a particular purpose
- that jobs will always process successfully
- that storage will be permanent
You use the Service at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law:
TexturingXYZ SARL and its affiliates, officers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of production time, loss of data, or business interruption.
Our total liability for any claim related to SKAP will not exceed the amount of credits you paid to us in the 30 days prior to the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless TexturingXYZ SARL from any claims, liabilities, damages, or expenses (including legal fees) arising from:
- your uploaded files
- your use of the Service
- your violation of these Terms
- your infringement of any third party rights
- your sharing or use of Resulted Maps outside the permitted license scope
13. Termination
We may suspend or terminate your account without notice if:
- you violate these Terms
- you misuse the Service
- we are required to do so by law
- continued access risks our infrastructure, legal compliance, or other users
You may terminate your account at any time by sending an email request at [email protected]. Credits remaining at termination are not refundable.
14. Changes to These Terms
We may update these Terms from time to time. The most current version will always be available on our website.
If changes are material, we will provide reasonable notice by email or through the Service. Continued use after changes means you accept the updated Terms.
15. Governing Law and Jurisdiction
These Terms are governed by French law.
Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the competent courts of Toulouse, France, unless mandatory consumer protection laws provide otherwise.
